Charges and Penalties for DWI in Texas

The legal sanctions for a DWI conviction escalate with each incident:

  • First offense: Up to a $2,000 fine, up to 180 days in jail, and driver’s license suspension for up to a year.
  • Second offense: Up to $4,000 fine, a jail sentence of at least one month, and perhaps as long as a year. The driver’s license can be suspended for as long as two years.
  • Third offense: A driver’s license can still be suspended for two years. That’s in addition to a fine that can now reach $10,000 and a prison term that will be a minimum of two years and potentially 10 years.

However, the repercussions of a DWI conviction don't stop at legal penalties. A DWI record can severely impact your personal and professional life. It could compromise future employment opportunities, increase insurance premiums, or cost you your auto insurance altogether. These convictions can also affect child custody arrangements depending on the context.

Facing these charges can feel overwhelming, but you don't have to do it alone. Our team at the Law Office of John C. Caldwell is here to help.

How to Fight a DWI Charge

The system isn’t always right. Believe it or not, DWI tests aren’t always accurate. People might face unwarranted prosecution simply because they’ve had a nominal—but not illegal—amount of alcohol. It’s important to have a lawyer who knows these mistakes get made, and understands how to look for them.

Three prime ways law enforcement can make an unjust arrest are:

  • Lack of probable cause: Law enforcement must have a specific reason to have made a traffic stop, to begin with, and another specific reason to issue a DWI test. If this prerequisite isn't met, any evidence obtained could potentially be suppressed.
  • Breath test error: The breathalyzer device must be administered properly to ensure accurate results. Factors such as the calibration of the instrument, the officer's training, and the timing of the test can all impact accuracy. Any discrepancies can be used to challenge the evidence.
  • Blood test error: From the moment of extraction to laboratory testing, each step should comply with strict protocols. Any violation of these standards can lead to contamination or degradation of the sample, which can call the blood test results into question.

A DWI charge doesn't necessarily mean a conviction. With a robust defense strategy, it's possible to challenge the evidence against you.
